The terms “we,” “us,” and “our” refer to kant studio. kant studio operates this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a personalized shopping experience (the “Services”). kant studio is built on Shopify, which enables us to provide you with the Services.

The terms and conditions below, together with the policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and obligations when using the Services.

Please read these Terms of Service carefully, as they contain important information about your legal rights.

By accessing, interacting with, or using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, you may not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are of legal age in the state or region in which you reside, and that you have given us your consent to allow any of your minor dependents to use the Services on devices that belong to you, that you have purchased, or that you manage.

To use the Services, including accessing or navigating our online stores or purchasing products or services we offer, you may be asked to provide certain information, such as your email address and billing, payment, and shipping information. You represent and warrant that any information you provide on our stores is accurate, current, and complete, and that you are fully entitled to provide such information.

You alone are responsible for the security of your account login details and for all activity on your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 – OUR PRODUCTS

We have made an effort to display our products and services in our online stores as accurately as possible. However, we point out that colors or the appearance of the products may differ from the colors displayed on your screen, depending on the device you use to access the store as well as its settings and configuration.

All product descriptions may be changed at any time and without notice at our sole discretion. We reserve the right to discontinue products at any time and to limit the quantities of products we offer to any person, geographic region, or jurisdiction, on a case-by-case basis.

KANT | MODULAR is assembled via a configurator from prefabricated standard components in the number and arrangement you choose. The regular statutory right of withdrawal under our Refund Policy applies to this product, as it does to all other products.

SECTION 3 – ORDERS

By placing an order, you are making an offer to purchase. kant studio reserves the right to accept or decline your order at its discretion for good cause. Your order is only deemed accepted once confirmed by kant studio. Acceptance of your order is subject to receipt and processing of your payment. Please review your order carefully before submitting it, as kant studio may not be able to accommodate cancellation requests once an order has been accepted. If we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number provided with the order.

Returns or exchanges of your purchases are handled exclusively in accordance with our Refund Policy.

You represent and warrant that your purchases are intended for your personal or household use and not for commercial resale or export.

SECTION 4 – PRICING AND BILLING

Prices, discounts, and special offers may change without prior notice. The price charged for a product or service is the price in effect at the time of ordering and will be stated in the order confirmation you receive by email. All prices shown are final prices. Pursuant to Section 6(1)(27) of the Austrian VAT Act (UStG) (small business scheme), no VAT is shown. Shipping costs are shown separately in accordance with our Shipping Policy.

Prices shown in our online stores may differ from prices in physical stores or in online stores or other shops operated by third parties. We may offer promotions for the Services from time to time that may affect pricing and that are subject to terms and conditions different from these Terms. In the event of a conflict between the terms of a promotion and these Terms, the terms of the promotion shall prevail.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made in our stores.

SECTION 5 – SHIPPING AND DELIVERY

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping providers, customs processing, or events beyond our control.

For consumers, the risk of accidental loss or accidental deterioration of the goods sold passes to you only upon handover of the goods (Section 7a KSchG); this applies regardless of the choice of carrier.

SECTION 6 – WARRANTY

The statutory warranty rights apply. For newly manufactured, movable goods, the warranty period is two years from handover of the goods. In the event of defects, you have the right to repair or replacement; only if this is impossible, involves disproportionate effort, or is unreasonable for us do a price reduction or rescission come into consideration. These statutory rights exist independently of, and in addition to, any manufacturer's warranty.

SECTION 7 – INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, trade names, text, illustrations, images, graphics, product reviews, video and audio files, as well as their design, selection, and arrangement, are the property of kant studio, its affiliates, or its licensors and are protected by copyright and other intellectual property laws.

These Terms of Service permit you to use the Services solely for personal, non-commercial purposes. Without our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material within the Services. All rights not expressly granted herein are reserved by kant studio.

The names, logos, product and service names, designs, and slogans of kant° are trademarks of kant studio or its affiliates or licensors. You may not use these trademarks without the prior written consent of kant studio.

SECTION 8 – OPTIONAL TOOLS

We may provide you with access to third-party tools that we neither monitor nor control. Such tools are provided “as is” and “as available”. Your use of optional tools is at your own risk and subject to the terms of the respective third-party provider.

SECTION 9 – THIRD-PARTY LINKS

Our Services may contain links to third-party websites. The respective operators are solely responsible for their content, accuracy and privacy practices. Linking does not imply our endorsement of such content.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

kant studio is built on Shopify. Your purchase contract is concluded exclusively with kant studio, not with Shopify. Shopify merely operates the technical platform and is not liable for the products sold or services provided through our Services.

SECTION 11 – PRIVACY POLICY

All personal data we collect is subject to our Privacy Policy.

SECTION 12 – FEEDBACK

If you send us suggestions, ideas or other feedback, we may use it without any obligation to compensate you in order to improve our products and Services. You warrant that your feedback does not infringe any third-party rights and does not contain unlawful content.

SECTION 13 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally our Services may contain typographical errors, inaccuracies or omissions, for example in product descriptions, prices, shipping costs or availability. We reserve the right to correct such errors and to update information. Your statutory rights, in particular regarding orders already accepted, remain unaffected.

SECTION 14 – PROHIBITED USES

You may not use the Services for unlawful purposes, infringe the rights of third parties, transmit malicious code, circumvent the security features of the Services or use the Services in a way that impairs their operation.

SECTION 15 – TERMINATION

These Terms remain in effect until terminated by you or by us. You may terminate them at any time by ceasing to use the Services. Purchase contracts already concluded and your statutory rights arising from them remain unaffected by termination.

SECTION 16 – LIABILITY

We are liable in accordance with statutory provisions for damage caused by intent or gross negligence, for personal injury and under the Product Liability Act. For slight negligence, we are liable to consumers within the scope of the statutory provisions. General information provided on our website is for guidance only and does not replace individual advice; liability for the accuracy of purely informational content (e.g. general product notes) is excluded to the extent permitted by law.

SECTION 17 – INDEMNIFICATION

Business customers shall indemnify kant studio against third-party claims arising from their breach of these Terms or of applicable law. Towards consumers, this applies only to the extent permitted by law.

SECTION 18 – SEVERABILITY

Should any provision of these Terms be invalid or unenforceable, the validity of the remaining provisions shall not be affected. Towards consumers, the invalid provision shall be replaced by the statutory provision.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to exercise any right under these Terms does not constitute a waiver of that right. These Terms, together with the policies referenced herein, constitute the entire agreement between you and us regarding the use of the Services.

SECTION 20 – ASSIGNMENT

You may not transfer rights and obligations under these Terms to third parties without our prior written consent. Statutory claims of consumers remain unaffected.

SECTION 21 – GOVERNING LAW AND JURISDICTION

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence. For claims by consumers against us, the courts at our place of business or at the consumer's place of residence have jurisdiction; for claims against consumers, the court of their place of residence has jurisdiction.

SECTION 22 – DISPUTE RESOLUTION

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. Our email address can be found in the legal notice. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

SECTION 23 – HEADINGS

Headings are for convenience only and do not affect the interpretation of these Terms.

SECTION 24 – CHANGES TO THESE TERMS

We may amend these Terms with effect for the future. The version published on this page at the time of your order applies.
